1. Who we are

The following terms and conditions (the "Terms") govern all use of the Chairside Communication Coach app and website ("the Service"), which are operated by Leah Krizak, doing business as Chairside Communication Coach ("the Seller").

2. Agreement to Terms

By using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service. We may revise the Terms at any time, and your continued use of the Service will constitute your acceptance of those changes.

3. The Service

The Service provides educational communication scenarios, scripting, and coaching content for both patients and dental professionals. Content is for informational and educational purposes only and does not constitute medical, clinical, legal, or financial advice.

4. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Prohibited Conduct

You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Service. This includes, but is not limited to, attempting to gain unauthorized access to the Service, transmitting any material that contains software viruses, or interfering with any other party's use and enjoyment of the Service.

6. Intellectual Property

All content included in or made available through the Service, such as text, graphics, logos, images, and software, is the property of the Seller and is protected by copyright and other laws. Your use of the Service does not grant you any ownership rights to the content. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service within the plan you have purchased. The license granted to patients is for personal, non-commercial use. The license granted to dental professionals is for internal professional development and training purposes within their own practice.

7. Payments and Subscriptions

Our order process is conducted by third-party online resellers, such as Paddle.com and Stan Store, who act as the Merchant of Record for our orders. These providers handle payment processing, customer service inquiries related to billing, and returns according to their own terms.

9. Termination

We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. The Seller makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

11. Limitation of Liability

In no event shall the Seller be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.
